Terms of Use

1.About these terms

Eti Image (“the plugin”) is an Adobe Photoshop plugin made and sold by Pouya Eti (“we”, “us”). These terms are the agreement between you and us. By buying, downloading, installing or using the plugin, you agree to them. If you don’t agree, don’t use the plugin.

If you accept these terms for a company or studio, you confirm that you’re allowed to bind it. Our Refund Policy and Privacy Policy are part of these terms.

2.Editions and what you get

• Eti Image is sold in two editions, Core and Pro. Each is a one-time purchase. There’s no subscription and no recurring fee from us.
• Your purchase includes every future update we release for your edition, at no extra cost. It doesn’t oblige us to release updates on a schedule, or to keep any particular model or feature.
• You download the plugin and its updates from your library at university.pouyaeti.com/library.
• If we offer a free edition, these terms apply to it too.

3.Your license

When you buy Eti Image, we give you a personal, non-exclusive, non-transferable license to use the edition you bought:

• by one person
• on up to two computers that person uses, for example a desktop and a laptop
• for personal and commercial work, including client work

Teams and studios need one license for each person who uses the plugin. If you need several, email support@pouyaeti.com.

The plugin is licensed, not sold. We keep all rights that these terms don’t expressly give you.

4.What you need

• A licensed copy of Adobe Photoshop, version 23.3 or later
• An account and API key with at least one supported AI provider: Replicate, Kie.ai, Google (Gemini API), OpenAI and Freepik
• An internet connection while generating
• You must be 18 or older, or have permission from a parent or guardian

5.AI providers and their costs

• The plugin sends your images and prompts to the AI provider you choose, using your own API key. The provider bills your account directly for each generation. We don’t receive or handle those payments.
• Prices shown in the plugin are estimates based on each provider’s published rates. The provider’s bill is the final amount.
• Each provider sets its own terms, content rules, prices and availability, and you agree to follow the terms of every provider you use. Providers can change or retire models, refuse requests or block content. We can’t control that, and we may change or remove a model in the plugin when its provider does.
• We aren’t responsible for charges on your provider accounts, including charges for generations that fail, are cancelled or are repeated.
• Keep your API keys private. Anyone who has a key can spend from the account it belongs to.

6.Acceptable use

You may not use the plugin to create, edit or share content that:

• is illegal where you live or where it’s published
• sexualizes minors in any way
• shows a real person nude or in a sexual situation without their consent
• depicts real people in order to deceive, defraud or defame
• infringes someone else’s copyright, trademark, privacy or other rights
• harasses, threatens or discriminates against people

You also may not try to get around the plugin’s content filters or a provider’s safety systems.

7.What you can’t do with the plugin

You may not:

• share, sell, rent or sublicense the plugin files, or upload them for other people to download
• share your purchase or download access with people who don’t have their own license
• modify the plugin to unlock an edition you didn’t buy, or remove its copyright notices
• copy the plugin’s code, prompts or design into another product, or use them to build a competing product

8.Your content

• You keep all the rights you have in the images and text you put into the plugin.
• We claim no ownership of what you generate. Your rights in AI-generated output depend on the law where you are and on the terms of the provider that produced it. In some countries, AI-generated images can’t be protected by copyright.
• AI output can be inaccurate, and it can resemble existing work, people or brands. Check it before you publish it or deliver it to a client. You’re responsible for how you use it.
• We don’t receive your images or prompts. The Privacy Policy lists exactly what the plugin sends us.

9.Updates and compatibility

• We may add, change or remove models and features, for example when a provider changes its service.
• Adobe updates Photoshop regularly. We work to keep the plugin compatible with current versions, but we can’t promise it will work with every future version.
• The plugin checks our server for new versions and short announcements. The Privacy Policy explains what those checks send.

10.Support

Support is by email at support@pouyaeti.com. We reply as quickly as we can, but we can’t guarantee a response time. Support covers installing and using the plugin. It doesn’t cover your AI provider accounts or their billing.

11.Refunds

Every purchase comes with a 14-day money-back guarantee. The Refund Policy explains how it works.

12.Ownership and trademarks

The plugin, including its code, design, prompt library and the name Eti Image, belongs to Pouya Eti.

Adobe and Photoshop are trademarks of Adobe. Replicate, Kie.ai, Google, Gemini, OpenAI, GPT and Freepik, and the names of the AI models, belong to their owners. Eti Image is an independent product. It isn’t made or endorsed by Adobe or by any AI provider.

13.No warranty

The plugin is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the plugin or any provider will be uninterrupted or error-free, or that it will produce any particular result.

14.Limitation of liability

To the fullest extent the law allows:

• we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, work or business
• we aren’t liable for charges on your AI provider accounts, or for content a provider generates
• our total liability for any claim related to the plugin is limited to the amount you paid us for it

Nothing in these terms limits liability that the law doesn’t allow us to limit, or takes away your statutory rights as a consumer.

15.Ending your license

You can stop using the plugin at any time. If you break these terms, we may end your license and remove your download access. Your license also ends if your purchase is refunded or charged back.

When your license ends, stop using the plugin and delete it from your computers. The sections on your content, ownership, warranty, liability and governing law continue to apply.

16.Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and we’ll email customers about significant changes. If you keep using the plugin after an update, the new terms apply to you.

17.Governing law

These terms are governed by the laws of the jurisdiction in which Pouya Eti operates, excluding its conflict-of-law rules. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live.
